These terms and conditions outline the rules and regulations for the use of Marriage Proposal in Rio's Website, located at https://marriageproposalinrio.com.

By accessing this website and booking our services, you agree to be bound by these Terms and Conditions. By checking the agreement box at the time of booking, you acknowledge that you have read, understood, and accepted all the terms listed below.

1. BOOKING AND PAYMENT TERMS

Booking Fee: A 30% non-refundable booking fee must be paid via PayPal to secure the date for your experience.
Remaining Balance: The remaining balance must be paid in full on the day of the session and experience. Payment must be made in cash (BRL only) or via credit/debit card (subject to card processor fees).
PayPal Surcharge: If the Client chooses to pay the full amount via PayPal, a 10% service charge will be applied.
Taxes and Fees: Prices listed do not include VAT (Value Added Tax) or other local/international taxes. The final amount may be subject to additional tax charges or transaction fees imposed by payment platforms.
Delivery Condition: Photos and/or videos will be delivered only after full payment has been received.

2. CANCELLATION AND MODIFICATION POLICY

Non-Refundable Fee: The booking fee is strictly non-refundable under any circumstance.
Late Cancellation: If the Client fails to attend the session or cancels within 24 hours of the scheduled date, the full remaining balance will be considered due and must be paid in full.
No Reductions: No reductions or downgrades in the selected package will be accepted after the booking has been confirmed and the agreement signed.

3. WEATHER AND FORCE MAJEURE

Rescheduling: If official weather forecasts indicate a probability of rain, the Service Provider reserves the right to reschedule the event within a 2-month window (based on mutual availability) or move it to a pre-arranged indoor location.
Client Insistence: If the Client explicitly chooses to proceed with the outdoor setup despite a forecast of rain or unfavorable weather, the session will be officially considered "performed," regardless of the conditions encountered or resulting limitations.
No Refunds for Weather: In the event that weather prevents the full use of equipment, decoration, or photography after the Client insisted on proceeding, no refunds will be issued, and the full balance remains due.
Artistic Integrity: The Client acknowledges that rain, wind, or poor lighting may affect the final aesthetic quality. The Service Provider is not liable for these natural influences if the Client chose to proceed.
Provider Force Majeure: In case of illness, accident, or other force majeure preventing the Service Provider from performing, a qualified substitute will be offered at no extra cost.

4. SESSION TIME AND DELAYS

Start Time: The event will begin at the scheduled time and place.
Delays: If the Client is late without prior communication, the delay will be considered part of the session time. No compensation or extra time will be offered for time lost.
Travel Time: Any travel time between locations during the photoshoot session is considered part of the total contracted session duration.

5. DELIVERY AND STORAGE POLICY

Photo Delivery: Edited photos will be delivered via online gallery within 10 business days after the event.
Video Delivery: Edited videos will be delivered within 15 business days.
Download Deadline: The Client must download photos within 7 days of receiving the link. After this period, the link expires, and a re-upload fee of BRL 200 will be charged for resending the gallery.
Storage: The Service Provider is not obligated to store files for longer than 30 days after delivery.

6. EDITING STYLE AND ARTISTIC INTEGRITY

Artistic Style: The Client acknowledges and approves the Photographer’s distinctive artistic style, including color, contrast, and composition.
Retouching Limits: Only basic adjustments are included. Post-production retouching such as skin smoothing, body alteration, or removal of objects/people is not included and requires separate invoicing.
No Style Changes: The Client may not request changes to the editing style or alterations that significantly deviate from the Photographer's creative vision.
Raw Files: Raw (unedited) files will not be delivered under any circumstances.

7. IMAGE USAGE RIGHTS

Marketing and Portfolio: The Client grants the Service Provider permission to use photos and videos for portfolio, website, social media, marketing materials, and publications, unless the Client formally requests otherwise prior to the session.

8. ADDITIONAL CONDITIONS

Logistics: Tickets, entrance fees, and transfers between locations are not included and must be arranged and covered by the Client.
Extra Photos: Photos beyond the contracted package can be purchased separately after the session.
Staff and Presence: The Service Provider may assign qualified team members or third parties to perform the services. The personal presence of Débora Oliveira is not mandatory unless expressly agreed in writing.
Decoration: Decoration will be defined based on options offered. Requests outside these options may incur additional costs.

9. WEBSITE USE AND INTELLECTUAL PROPERTY

Ownership: Marriage Proposal in Rio and/or its licensors own the intellectual property rights for all material on this website. You may not copy, sell, or redistribute material from this site for commercial purposes.
